Gut Wellness Packages & Future of Nutrition Program

By purchasing a Gut Wellness package or Nutrition Program, you agree to these terms of service and the terms of use on my website.

Payments

Refunds

Wellness Packages and Programs are non-refundable if you change your mind, so please ensure the package is suitable for you and ask all questions before you sign up. If you are prevented from participating due to circumstances beyond your control, please email me to discuss the situation as I may agree to pause your package for up to 12 months.

I reserve the right to terminate a package at my discretion, in which case you will receive a prorata refund based on how much of the package has been delivered.

I take my obligations under Australian Consumer Law seriously and will do my best to take reasonable steps to address any issues that arise. However, even if there is a major problem, my liability is strictly limited to:

- replacing the goods or providing the services again; or

- if I am unable to do so within a reasonable time, refunding the full amount that you have paid to me.

If you feel that there is any problem with my services, please let me know within 24 hours of a consultation, or as soon as possible. I am keen to understand what has gone wrong if you are unhappy so that I can address your concerns and try to find a mutually acceptable solution.

Package Payment Plans

Payment plans are offered for your convenience only, so you can spread your payment out over time. You are still committed to paying the whole amount, even if you change your mind about completing the program, as you have had access to my intellectual property and I have allocated space in my calendar and made myself available for your consultations, which has prevented me from booking in other clients.

Payment plans will be processed through Stripe. Payments are debited automatically every 2 weeks. It is your responsibility to ensure you have sufficient funds to make payment instalments on time. If a payment fails, Stripe will attempt to process the payment again.

If payment fails, Stripe will attempt to process the payment twice more. If payment still fails to go through, your access to the program will be paused while I contact you to remedy the situation.

All sessions, calls and services are postponed until payment is received.

I reserve the right to charge an administrative fee of $27.50 on late payments each time I have to contact you to arrange payment. If you are having trouble paying, please contact me so we can make alternative arrangements. However, if I don’t hear from you, I will enforce my boundaries around payment.

If your invoice is more than 60 days overdue, I will engage a debt collector and any outstanding consultations or entitlements under the program will be forfeited. You agree to pay all costs, including debt collection agency fees and solicitor’s costs, that I may incur in taking steps to recover any money that you owe under this agreement, whether or not legal proceedings are issued in relation to the debt.

Appointment Policy & Package and Program Expiry Limits

In addition, by signing this form you understand and agree that you must provide me with 48 hours’ notice to cancel or reschedule a consultation. Failure to provide sufficient notice will result in your consultation being forfeited as I have reserved this space in my calendar and have been unable to book another client into that time. If you are prevented from attending due to circumstances beyond your control, please contact me as soon as possible. I may agree to reschedule at my discretion, but this will incur an administrative fee of $55.

The Gut Wellness Package is designed to be a 3 month journey and as such all consultations, testing and results need to be carried out in a timely manner as soon as you sign up to the package. Unless written notification and agreement via email is sought, failure to reply to emails for bookings and failure to provide test results within 3-4 weeks of commencing the package will result in forfeit of services included in the package. This includes failure to respond to emails within 2 weeks of commencing the package or if email communication is not responded to within 2 weeks by the client.

The Future of Nutrition Program is a 6 month program that must be completed within the 6 months unless written email communication is sought and agreed upon, all consultations and tests must be carried out during the 6 month. Failure to seek extension with 3 weeks notice will result in forfeit of any outstanding services.

Ebooks and Webinars

Lucia Rivas-herry: Nutrition is Medicine eBooks and downloadable products have a strict no-refund policy so please be sure the product is right for you before buying.

It is your responsibility to download your eBook and keep it in a safe folder for future reference. Links will not be re-issued after 7 days. If, however you experience difficulty accessing or downloading your purchased product, then help is available. Please also note that creating a backup file for your eBook is solely your responsibility. We will not re-issue links for loss or damage of computers. Backing up is the only way to ensure that your eBook is not lost should your hard drive fail. Customers are solely responsible for confirming that their devices are compatible with the eBooks they purchase. Refund will not be issued due to compatibility issues.

Although not required, it is suggested you insure returns, as we are not responsible for items lost in transit
(Please note that insurance up to $100 is a cost of $2.50 only within Australia). Please contact us before buying if you require this service.

When it comes to returns or exchange, we operate a “fair and reasonable” policy. All items are thoroughly inspected for defects at our depot prior to shipping. You should contact us immediately on receipt of your parcel (within 3 days) if you believe there is an error and deem it necessary to return the item. Please note; this is not for eBook or webinars.

eBooks are sent digitally to the email address registered with the purchase. If you do not receive your eBook, please check your junk folder and add Nutrition is Medicine as a trusted recipient.

DNA and Microbiome Kits and Lab testing

DNA and Microbiome kits are sent as quickly as possible from when the purchaser orders the kit and it is a smartDNA kit or Microba kit with full instructions provided, please ensure you read those carefully and return in a padded envelope to ensure the kit arrives safely to the laboratory.

All smartDNA gene and Microbiome and Microba Microbiome test orders are non-refundable, this is because once an order is placed and the test kit is sent, the lab test is also ordered and cannot be stopped once it’s underway. SmartDNA privacy policy and terms and conditions can be viewed here.

Please ensure this is read to ensure you understand data confidentiality and privacy.

DEFECTIVE DNA OR MICROBIOME KITS

If a DNA kit does not arrive in good condition and is broken due to transit, please let Nutrition is Medicine know so that a replacement can be sent within 7 days of receiving it and only if there is photographic evidence that the kit was broken and unusable due to transit.

Items must be returned within (7) seven days of the purchase date to be eligible for replacement. Items will be replaced with the same item originally purchased.

If goods (DNA kit) are faulty, wrongly described or different from a sample shown, you may choose between a refund, exchange or credit. Please see instructions below for Defective Items.

For items that cannot be replaced, a full refund will be offered. This only applies to DNA kits that have not been used. If you accidentally break or misplace the kit, it will need to be replaced at cost of the purchaser. Please email lucia@nutritionismedicine.com.au should this occur.
